Safety Reporting and Response Records

A Freedom of Information Act request to Birmingham Public Schools. PAACT has asked for three years of safety reporting records. This page funds the district's $280 processing fee.

What we asked the district for

Birmingham Public Schools uses several channels to receive safety concerns: the Bullying, Hate, or Bias Reporting Form, the state's OK2Say tip line, and direct reports to building administrators. PAACT has filed a FOIA for the records that document how those channels are used and how the district responds.

  1. Bullying, Hate, or Bias Form submissions received through the district's online form, including category, school, response, and any referrals.
  2. OK2Say tips referred to BPS by the State of Michigan for district follow-up.
  3. Threat assessment records at the aggregate level, including counts by building and threshold categorization.
  4. Restraint and seclusion records aggregated by building, intervention type, and student status.
  5. Emergency drill after-action reports for ALICE, lockdown, evacuation, and shelter-in-place drills, plus accompanying parent communications.
  6. Title IX complaint logs at the aggregate level.
  7. Anti-harassment and anti-bullying complaint logs at the aggregate level, separate from the online form submissions.

The records cover the period July 1, 2023 through the date the request is processed.

Hello,

Pursuant to the Michigan Freedom of Information Act (MCL 15.231 et seq.), Parents Allied for Accountability, Conduct, and Transparency requests copies of the following public records held by Birmingham Public Schools.

Records Sought

For the period July 1, 2023 through the date this request is processed, please provide:

  1. BPS Bullying, Hate, or Bias Reporting Form submissions. Number of submissions and all reports received through the Google Form linked from the district's Safety Concerns page. For each submission, please include: date received, school referenced, category of concern, the substance of the report (with FERPA-required redactions of personally identifying information), the response or action taken by the district, and any referral made to law enforcement, central administration, or building administration.
  2. OK2Say tips referred to Birmingham Public Schools. All tips forwarded by the State of Michigan's OK2Say program to BPS for follow-up during this period, with the same data elements as item 1. I understand BPS does not hold the full scope of OK2Say tips originating in the district. This request is limited to those forwarded to BPS by the state.
  3. Threat assessment records, aggregate level. The count of threat assessments conducted by BPS during this period, broken out by school building and school year, with the threshold categorization assigned to each (using whatever framework the district employs, such as low, moderate, high, or imminent). Please also include any standing threat assessment protocols, procedures, or training documents currently in use.
  4. Restraint and seclusion records. Aggregate counts of restraint and seclusion incidents at each BPS building during this period, broken out by type of intervention (physical restraint, mechanical restraint, seclusion) and by student status (general education or special education). Individual incident reports are not required if aggregate data can be provided.
  5. Emergency drill after-action reports. All after-action reports, post-drill evaluations, or incident reviews generated for ALICE drills, lockdown drills, evacuation drills, or shelter-in-place drills conducted at any BPS building during this period. And the accompanying communication to parents informing them of the incident.
  6. Title IX complaint logs, aggregate level. The count of Title IX complaints received by the district during this period, broken out by building, school year, category of complaint, and disposition. No individual records or identifying information are requested.
  7. Anti-harassment and anti-bullying complaint logs, aggregate level. The count of complaints received under the district's anti-harassment and anti-bullying policies during this period (separate from the Bullying, Hate, or Bias Reporting Form addressed in item 1), broken out by building, school year, category, and disposition. No individual records or identifying information are requested.
Format Preference

Please provide all responsive records in electronic format, delivered via email or secure file transfer where file size requires it. Native digital format (CSV, Excel, or original document type) is preferred over scanned or printed copies where possible.

Fees

If you anticipate the cost of fulfilling this request will exceed $50, please provide a written estimate before proceeding so I can review the scope. I am willing to narrow the request where needed to manage costs.

Timeline

I understand the district has five business days to respond under MCL 15.235, with a possible ten-business-day extension. Please confirm receipt of this request and indicate the expected response timeline.

Re: Freedom of Information Act Request – Notice of Fee Deposit

Dear Ms. McDaniel:

This letter will serve as Birmingham Public Schools' (the "District's") preliminary determination in response to your Freedom of Information Act ("FOIA") request received by the District on June 4, 2026. Please note that all future requests must include an address written in compliance with United States Postal Service addressing standards. MCL 15.233.

Your request is hereby granted in part and denied in part. Your requests are granted as to existing, non-exempt records in the possession of the District that fall within the scope of your requests. The anticipated basis for partial denial of your requests includes:

  • Information that, if disclosed, would violate the Family Educational Rights and Privacy Act pursuant to MCL 15.243(2).
  • Information of a personal nature if public disclosure of the information would constitute a clearly unwarranted invasion of an individual's privacy pursuant to MCL 15.243(1)(a).
  • Records of information specifically described and exempted from disclosure by statute. MCL 15.243(1)(d).
Fee

The estimated charge for the requested records is $280.00. Please see the enclosed Fee Itemization Form. MCL 15.234. Failure to charge a fee would result in an unreasonably high cost to the District in this particular instance because employees must be taken away from pending work to process the request and expend additional time to complete regularly assigned work. Specifically, employees will be taken away from regularly assigned work due to the need to search for, locate, appropriately examine, and separate and redact exempt information from records responsive to your request.

Good Faith Deposit

Because the currently estimated fee exceeds $50.00, the District requires a fifty percent (50%) deposit of the estimated fees to be paid before your request is processed. Should you wish to proceed, remittance of a one-half good faith deposit in the amount of $140.00 is required to begin work on your request for records.

Pursuant to MCL 15.234(14), if a fee appeal has not been filed under MCL 15.240a, the District must receive the required deposit no later than August 3, 2026. If the District does not receive your deposit by this date, your request will be considered abandoned and the District will not be required to fulfill the request.

This is not a final determination. It is estimated that the District will complete processing your request within fifteen (15) business days following receipt of the deposit. You will be notified of the balance due, along with the statutory basis for any exemptions and your statutory remedial rights, if applicable. Non-exempt records will be provided upon receipt of the balance.

The cost and the time frame for producing records are good-faith estimates, not guarantees, and are provided by the District in good faith.

Statutory note from the worksheet: If the estimated fee is over $50.00, the District shall charge a good faith deposit of 50% of the estimated fee. Failure to pay the deposit within 45 days of the District's notice constitutes abandonment, and the District is no longer required to fulfill the request. The deposit is due by August 3, 2026.

What happens when this is fully funded

We pay the district immediately. Once the campaign reaches its goal, PAACT submits payment to BPS so the request can be processed without delay.

We publish the records within 30 days of receipt. The full set of records, with any FERPA-required redactions applied by the district, will be posted on this site as a parent resource.

We share what we find, honestly. If the records show the system is working well, we will say that. If they show gaps, we will document them. The analysis is the work, and we publish what the data actually shows.

About your contribution Contributions to PAACT are not tax-deductible. PAACT is a parent coalition, not a 501(c)(3) charitable organization. We accept donations to fund specific accountability work, and we publish records of how every dollar is spent.
Hard cap This campaign stops accepting donations when the goal is reached. We do not collect more than the actual fee amount the district has quoted.
Refund policy If the district denies the request, if PAACT withdraws it, or if the records cannot be produced for any reason, every donor receives a full refund to the original payment method. If the district revises the fee estimate downward, the difference is refunded proportionally to donors.
Platform processing Donations are processed through Donorbox and Stripe. Platform processing fees (approximately 3% to 4% per donation) are absorbed by PAACT and do not reduce the amount delivered to the district.
